La dictadura militar brasileña ahondó en el proceso de criminalización de la pobreza, conjugándolo con su Ideología de la Seguridad Nacional y de necesidad de control del orden social. Su discurso respecto a la criminalidad infantil se caracterizó por considerar a los menores de edad pobres como criminales potenciales, como “problema social” y como “culpables” de su propia marginalidad. Al mismo tiempo, aunque legislación y operadores del sistema hablaban de re-educar y no castigar, el contexto dictatorial y represivo, así como el discurso victimizador que proyectaba una imagen del niño/a pobre como “producto social defectuoso”, provocaron que la dinámica penal-retributiva en ningún momento abandonase la faceta práctica del tratamiento. Las pregunta son, ¿cuál era la posición de las niñas y adolescentes infractoras en este universo?, ¿recibían el mismo tratamiento que los muchachos?, ¿o la dictadura proyectaba diferentes ideologías y políticas sobre ellas?

The Brazilian Military Dictatorship went deeper in the criminalization of poverty process, joined with its National Security Ideology and the necessity of control of the social order. Its ideology about children criminality was defined by characterizing the poor minors as potential criminals, as “social problem” and as “guilty” of their own marginality. And, although the laws and the jurists talked about re-education and not about punishment, the dictatorial and repressive context and the speech that projected an image of the children as “social faulty product” made that a penal-retributive dynamics never abandoned the real treatment. Our questions are, what was the position of the criminal girls and teenagers in that universe?, did they receive the same treatment that the boys?, or did the Dictatorship project other ideologies and politics on them?
