Welcome to Enfopol Watch. Remember that name? It is a set of technical requirements for the law enforcement bodies, related to interception and surveillande of communications at European level. You probably didn´t hear about them for some time. However, its threat is far from over. Not only are the Enfopol "requirements" still alive and with good health, but they´re being enlarged even more as we speak.
This sections is created to inform about the status of the laws that will give statutory power to the Enfopol requirements in the whole European Union, as well as that of the laws that pretend to oppose the big-brotherization of our Europe of liberty, security and justice. So far, these are the most relevant ones:
- In the Dark Side of the Force there is the Convention on Mutual Assistance in Criminal Matters between the Member States of the European Union. Its Title III (Interception of Communications) contains the legal text that, together to the technical requirements (under work at the European Telecommunications Standard Institute, will turn Enfopol into a big-brotherish reality. All with little -if any- public debate. For the greater benefit of public security, of course. The Convention was approved by the Council of Ministers of Justice and Home Affairs during its 29 June 2.000 session. But the text is still to be ratified by national parliaments.
- On the other hand, the European Parliament and the Commssion have formed a sort of rebel alliance and are preparing Directive COM (200) 385 on data protection and privacy in electronic communications. This Directive, among other things, will forbid the use and access to the so-called traffic data (data associated to a call, but not including the call itself). European law-enforcement bodies call for a routinary access to those data in an unprecedented scale. The Directive is trying to prevent "law and order" considerations from being the excuse to further erode citizens´ communications privacy rights.

Saludo de bienvenida
Bienvenido a Enfopol Watch. ¿Recuerdas Enfopol? Es un conjunto de requisitos técnicos para las autoridades policiales, relativos a la interceptación y vigilancia de las comunicaciones a nivel europeo. Probablemente no hayas leído nada al respecto desde hace algún tiempo. Pero eso no significa que la amenaza haya desaparecido. No solamente los "requisitos" Enfopol siguen vivos y coleando, sino que están siendo ampliados aún más.
En esta sección se pretende dar información acerca del estado de la leyes que dará cobertura jurídica a los requisitos Enfopol en todo el territorio de la Unión Europea, así como a aquéllas leyes que se oponen a una granhermanización de nuestra Europa de libertad, seguridad y justicia. Estas son, por el momento, las más relevantes:
- En el lado oscuro de la Fuerza se halla el Convenio relativo a la asistencia jidicial en materia penal entre los Estados miembros de la Unión Europea. Su Título III (Intervención de Comunicaciones) contiene el ordenamiento legal que, junto con los requisitos técnidos (que están poniéndose a punto en el Instituto Europeo de Estándares de Telecomunicaciones, ETSI) convertirá Enfopol en una granhermanesca realidad. Todo con poco debate o escrutinio público, por no decir ninguno. Para nuestra propia seguridad, por supuesto. El Convenio fue aprobado por el Consejo de Ministros de Justicia e Interior de la Unión Europea en su reunión del 29 de Junio. Pero el texto aún ha de ser ratificado por los parlamentos nacionales.
- Por otro lado, el Parlamento Europeo y la Comisión hacen el papel de la alianza rebelde y están redactando la Directiva COM (2000) 385 sobre protección de datos y privacidad en las comunicaciones electrónicas. Esta Directiva prohibirá, entre otras cosas, el uso y acceso a los llamados datos de tráfico (datos asociados a una llamada, pero que no incluyen el contenido de la llamada en sí). Las policías europeas persiguen conseguir tal acceso de forma rutinaria y a una escala sin precedentes. La Directiva intenta impedir que las consideraciones de "ley y orden" sean convertidas en una excusa para erosionar el derecho de los ciudadanos a la privacidad de sus comunicaciones.
Puesto que este es un esfuerzo a nivel europeo, esta página es bilingüe. No puedo asegurar el éxito, ya que quince parlamentos en diversos idiomas son algo difíciles de digerir para una sola persona. Se hará lo que se pueda.
